1. Updates to these Terms of Sale We may change these Terms of Sale from time to time, so please check them regularly to stay up to date with the latest version. The latest version of these Terms of Sale will always be available on the Platform. The latest version of these Terms of Sale will be effective immediately on the date of posting and will apply to all orders for products and services placed after that date. Changes to these Terms of Sale made after you have placed an order will not affect that order or your relationship with us, unless required by applicable law.
2. Eligibility to Purchase
Only individuals (other than legal entities) who (a) have reached the required age of majority to enter into a contract and (b) have the legal capacity to enter into a contract may order products through the Sales Channels. If you are under the age of majority or are otherwise unable to legally enter into a contract, your parent or guardian must place the order on your behalf and will be required to accept these Terms of Sale.
By placing an order through the Sales Channels, you represent and warrant that you are a bona fide end user making a purchase for your own or someone else's personal use, that you will not distribute, sell or otherwise distribute our products, and that you will not purchase our products or services for any commercial purpose.
3. Product Availability & Quantity
For information on processing your order, please see section 6. Order Process below.
You may only order up to 5 items at a time. If you wish to order more than 5 items, you may place two or more separate orders. If you wish to pay by cash on delivery, please note that the total value of your order on the Sales Channels must be less than 500,000 yen.
Other order restrictions may apply depending on the product. We reserve the right to refuse any order for any authorized product that exceeds a certain quantity at any time without prior notice.
4. Registering an Account & Guest CheckoutWhen you place an order, you can either register and create an account, or choose "Guest Checkout" to order as a guest without creating an account. If you order as a guest, an account will still be created in our internal systems to record your purchases.
5. Personalization services
You may request personalization services (engraving, embossing, etc.) and other services for your ordered products. If you would like to request personalization services, please provide us with the details required by the Sales Channel.
However, we reserve the right to withhold or refuse any order for personalization services or the creation of message cards for products that contain language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that the language used in the personalization services is correct.
Furthermore, please note that orders for personalized products cannot be cancelled and that products that have been personalized in any way or otherwise customized to your specifications cannot be returned to us for exchange or refund, as provided for in these Terms of Sale. This does not affect your rights as a consumer. (For more information, please see section "15. Manufacturer's warranties and your legal rights as a consumer".)
6. Order Process
The order process on the Platform will proceed as follows:
・Add to Shopping Bag: Once you have selected the product, place it in your shopping bag. You can then continue shopping for other products and add them to your shopping bag (subject to availability and quantity restrictions). Adding a product to your shopping bag does not guarantee that the product will be available for purchase. Please note that your order is not confirmed until you receive an order and shipping confirmation email.
・Guest/My Account Checkout: Once you have selected the products, proceed to "Checkout" as a guest or with a registered account. You can also remove selected products from your shopping bag during checkout.
Delivery, Confirmation and Payment: During checkout, review your order details and personal information (email address, shipping address, billing address, payment information, etc.) and add more information if necessary. Please carefully review all details listed on the order page before confirming your order.
・Confirm Order: Check the appropriate box to confirm your order.
If you place your order via the Customer Service Centre, a Cartier ambassador will walk you through the above process and verbally confirm your order details. We reserve the right to refuse, cancel or terminate an order at any time for reasonable cause in our sole discretion. For example, we may refuse, cancel or cancel an order if there is an ongoing dispute regarding payment for a previous order or if, in our sole discretion, we suspect (i) fraudulent activity, or (ii) any other activity that violates these Terms of Sale.
7. Prices, Taxes and Shipping Costs
All prices shown on the product pages of the Platforms or communicated to you by our Customer Service Centre are in US dollars. Shipping costs are free for both domestic and international customers. Consumption tax is charged separately for customers in Japan. Import duties, VAT and other related fees and taxes for deliveries outside Japan are not included unless otherwise stated, and may be paid by you separately.
We reserve the right to change prices and shipping costs at any time without prior notice.
We take reasonable care to ensure that the prices of products and shipping costs are correct when the relevant information is entered into the system or when you contact us via our Customer Service Centre. However, despite our reasonable efforts, it is always possible that some products or shipping costs offered through the Sales Channels may contain inaccurate pricing. If the price of the product you have ordered or the shipping cost for that product is incorrectly displayed, we will notify you of this error as soon as possible. If we are unable to contact you using the contact information you provided when placing your order, we will cancel your order and notify you of this by phone, email or in writing. If we have mistakenly accepted and processed your order with an incorrect product price or shipping cost, we will cancel the delivery of the product and refund all amounts paid for that order.
If applicable laws change between the date of your order and the date we send you the order and shipping confirmation, the amount of tax associated with your order may change. If such changes result in an increase in the amount of tax you are liable for, we will contact you to reconfirm your order.
8. Payment
Only payment methods identified as part of the order process on the Sales Channels are accepted. Depending on the payment method you choose, you may be required to provide additional information, including proof of identity.
When placing an order on the Platforms, you will need to enter your payment details into the appropriate form. When placing an order over the phone, you will need to provide all your payment details to our Customer Service Centre. All credit card payments are subject to validation checks and authorization by the credit card company. If your credit card company refuses to pay us, you will need to contact your card company yourself to resolve this issue.
Other payment methods may also be subject to validation checks and authorization from the payment system. You expressly authorise us to carry out security checks on you and, where we deem necessary, to transmit or obtain information (including changes) to or from third parties (including, but not limited to, your card details) for the purposes of authenticating your identity, validating your card, authorising your card and authorising your individual purchase transactions, as appropriate.
Payments by credit card are accepted by Mastercard, VISA, JCB, American Express and Diners Club. Your chosen payment card will be debited for the full purchase price immediately after your order is shipped. Prepayment does not affect your statutory rights under these Terms of Sale, including your right to a refund. If we are unable to fulfil our shipping/delivery obligations as set out below, we will contact you by telephone, email or in writing and will refund any prepayment promptly and without undue delay.
Some credit cards allow you to pay in instalments. This payment method is subject to the terms and conditions of your credit card company.
We may, at our sole discretion, accept payment by bank transfer. We do not charge any bank transfer fees for orders placed through the Sales Channels or Customer Service Centre, however your financial institution may charge you a fee. If you wish to pay by bank transfer when placing an order over the phone, all orders must be confirmed through an authorization process. You may pay by bank transfer, but please note that your order will not be processed until we have confirmed your bank transfer payment by email. If we do not receive your bank transfer payment within 5 business days of the date of your order, your order will be cancelled.
Cash on delivery is available for standard delivery orders up to 500,000 yen (including consumption tax) (not available for next-day delivery and same-day delivery). Cash on delivery is not available for products with personalized services. You or your representative must pay the price in cash on the spot when the product arrives. Please note that the delivery company does not accept credit cards or debit cards. If you are unable to pay when the product arrives, the delivery company will either visit you again the next day or you will have to specify a new delivery date for the delivery company.
9. Confirmation of Order Receipt
Once you have selected and placed your order through the Sales Channels, you will receive a confirmation of your order (along with your order number, which may be sent by email or other means). Please keep this order number handy, as you will need it if you need to contact us about your order. This confirmation of your order does not mean that we have accepted your order. To accept your order, we will carry out the usual credit, fraud, security and related legal checks and, if the checks are satisfactory, we will proceed to accept your order. It is your responsibility to ensure that the confirmation of your order is a correct reflection of your order. If you have any questions or concerns, or if your order confirmation is not correctly reflected, please contact our Customer Service Centre immediately.
These Terms of Sale will be provided to you when we confirm receipt of your order.
10. Delivery Policy
We do not deliver to PO boxes or public facilities (hotels or corporate facilities). If you specify a PO box or public facility as the delivery address for your order, we will be responsible for the delivery until the delivery is completed by the courier. Any warranty for the product after delivery is the sole responsibility of the customer and is not covered by insurance. For more information, please contact our Customer Service Center.
If you order multiple items, we will ship them together once all items are available (they will not be shipped separately unless you contact us otherwise).
11. Shipping & Notification of Shipment
Once your order has been shipped, you will receive a confirmation email (either by email or other means). This notification is our acceptance of your order and indicates the formation of a binding sales contract.
We reserve the right not to accept your order for any reason, in our sole discretion. Examples of reasons for not accepting your order include, for example, that the ordered item is not in stock, we are unable to verify your credit card, or you do not meet the eligibility requirements.
12. Delivery
We will use reasonable efforts to ensure that you receive your order within the expected delivery time from the date of the dispatch confirmation email and, in any event, within 45 days from this date, unless your order relates to a product or service for which we have explained to you that it will take longer to deliver, for example if you have used our personalisation services or have customised the product to your specifications.
If you place an order through the Sales Channels, you can choose a delivery date from the options available on the Sales Channels. Such delivery date is subject to confirmation from us.
If the delivery of the product is delayed due to reasons beyond our control, we will notify you as soon as possible and will use reasonable efforts to minimise the impact of the delay. If we are unable to deliver your order within 30 days of the dispatch confirmation email or such other deadline as may be specified by us, you may contact our Customer Service Centre to cancel the order and receive a refund of any amount already paid for the unaccepted products.
In any case, your only remedy for our failure to deliver your ordered goods on time shall be the right to cancel the relevant order and receive a refund of any monies already paid for the unreceived goods.
When estimating delivery times, please allow for the time it takes to authorise your credit card, verify your delivery address, carry out security checks and process your order. Please note that delivery is subject to receipt of your payment in full.
You will be required to sign for the delivery of your goods. Before signing, it is your responsibility to inspect the delivery box for any damage or other defects. If there is any damage or defect, you must notify the delivery company immediately. This signature will be your confirmation that the ordered goods have arrived and that you have received them. After signing, no claims will be entertained, whether for lost or stolen goods or for reasons such as non-compliance with your order.
13. Invoices When you order Products via the Sales Channels, you will receive an invoice (either by email with a PDF invoice attached to your designated email address or by other means).
14. Returns & Exchanges
(a) Right of Cancellation
You have the right to cancel the sales contract concluded by sending us the dispatch confirmation, without giving any reason, within 14 days from the day on which you or your designated person (other than the carrier) acquires and takes possession of the ordered products.
To cancel the contract and return the ordered products, please contact our Customer Service Centre.
(b) Return Procedure
Products purchased through the Sales Channels may be returned to the Cartier e-Boutique Distribution Centre at the address of the Returns Department provided by the Customer Service Centre, in accordance with these Conditions of Sale.
Products not purchased through the Sales Channels cannot be returned to the e-Boutique Distribution Centre.
When returning products to the e-Boutique Distribution Centre, please follow the steps below:
Call the Customer Service Centre.
At this stage, we may ask you for some information about the returned products to allow us to make an initial assessment of their condition.
A Customer Service Centre representative will ask you to bring the Return Form that was included in the product packaging. If you do not have it, we will send it to you by email.
Complete the Return Form and sign it.
Please place the product you are returning, its packaging, the completed return form, together with any accessories, any free items you received as part of your order, the service guide, warranty card, or any other documentation, in the original box in which it was delivered.
Close the return packaging and hand it over to the courier.
Only products received by our distribution center will be eligible for a refund or exchange.
You may be asked to provide information about the product to allow us to assess the initial condition of the returned product.
(c) Condition of the returned product
We will verify whether the returned product meets the conditions set out in 14. Return and Exchange Policy and, if so, will process the applicable return or exchange.
We will only accept returns of products that are new, unused, and in perfect condition, with all protective materials, product tags and labels attached (if applicable), and in the original Cartier box and shipping packaging, along with all accessories and documentation. For example, if you have adjusted the bracelet of your watch, please make sure to return all links that were included in the original packaging. We reserve the right to refuse a return if the product shows signs of wear, is used or has been altered in any way from its original condition.
If you received a free item as part of your order, please return this along with the product.
All returns are subject to strict quality control ("QC") by us to ensure that the returned product meets these requirements. If the returned product does not meet the QC standards, we will refuse it and it will be returned to you. If the returned product meets the QC standards, the applicable return or exchange will be processed.
We may refuse the returned product and return it to you at your expense if it does not comply with these Conditions of Sale.
(d) Products that cannot be returned or exchanged Please note that products ordered that have been personalised in any way or have been otherwise customised to your specifications cannot be returned to us for exchange or refund. This includes products that have been engraved or embossed.
(e) Refunds You may return products purchased through the Sales Channels for a refund. However, returns must comply with these Terms of Sale, in particular (a) Cancellation Rights and (b) Returns Process above.
Only the original purchaser of the product will be entitled to a refund of the purchase price. In all cases, those who receive products as gifts ("Gift Recipients") will not be entitled to a refund. If a Gift Recipient wishes to return a product, they should call our Customer Service Centre to discuss their options.
If the return complies with these Terms of Sale, we will use commercially reasonable efforts to refund the purchase price by the same means used by the Purchaser to pay for the original product within 30 days of receipt of the returned product from our e-boutique distribution centre.
If you have paid by cash on delivery or bank transfer, you will be asked to complete a return form or provide your bank account details by calling our Customer Service Centre in order to process the refund. Rest assured that there are no fees associated with this refund process.
If you return an item purchased through the Sales Channels to a Boutique (see the Frequently Asked Questions section or contact our Customer Service Centre to find the appropriate Boutique), the amount will be refunded to the credit card used for the purchase, or by bank transfer if you paid by cash on delivery or bank transfer. Please note that cash refunds are not available for returns in Boutiques. Please see the Frequently Asked Questions section or contact our Customer Service Centre for more information.
(f) Exchange
You may return an item purchased through the Sales Channels in exchange for another item, provided that your return complies with these Conditions of Sale and in particular with (a) Right to Cancel and (b) Return Process above.
In all cases, the sale of the returned item will be cancelled and a new order must be placed for the selected item.
If an item is returned to the e-Boutique Distribution Centre in exchange for an item of lower value than the originally purchased item, only the purchaser of the returned item will be entitled to a refund of the difference in price.
If you return an item to a boutique in exchange for an item of lower value than the original purchase, the amount will be refunded to the credit card used for the purchase, or by bank transfer if you paid by cash on delivery or bank transfer. Please note that cash refunds are not available for returns in boutiques. Please contact our Customer Service Center for more information.
If you return an item to exchange for an item of higher value than the original purchase, you will have to pay the difference in price.
15. Manufacturer's warranty and your legal rights as a consumer
We strive to ensure that each product strictly adheres to our quality standards and passes all of our controls, both technically and aesthetically.
The Cartier Guarantee applies to the product you have selected. If you wish to have a product repaired that is covered by the Unexplored Warranty, please refer to the applicable Unexplored Warranty and contact our Customer Service Centre for further information.
As a consumer, you have legal rights under the laws governing the sale of consumer goods. Nothing in these Terms of Sale affects those legal rights or any applicable Unexplored Warranty.
16. Complimentary Services
The following complimentary services are available through the Sales Channels:
(a) Gift Wrapping & Packaging
All orders can be gift wrapped in a gift box with special packaging, or you can choose not to have your order gift wrapped. Your order will be shipped with a shopping bag (if applicable).
(b) Engraving/Embossing
Engraving and embossing services are available for certain products.
If you would like your product to be engraved or embossed, please contact our Customer Service Centre for more information.
You cannot cancel an order that has been personalized, nor can you return a personalized product to a boutique for an exchange or refund.
(c) Gift Cards
You can also include a personalized gift card with your desired message printed by Cartier in the packaging of your order. However, Cartier reserves the right to refuse to include a gift card if the message sent on the logo-bearing gift card is deemed offensive or inappropriate.
17. Repairs
For repairs on Products ordered through the Sales Channels, please contact our Customer Service Centre.
18. Product Descriptions We endeavour to ensure that the information displayed on the Platforms, in advertisements, catalogues or provided through our customer service centres, including but not limited to product descriptions, sizes, colours etc., is accurate and complete. However, we make no warranty, express or implied, as to the accuracy, reliability or completeness of such information. In particular, any representations and information regarding the weight of precious materials and the number or carats of gemstones are provided for illustrative purposes only and may vary slightly from the actual product.
19. Limitation of Liability
To the fullest extent permitted by applicable law, we disclaim and exclude all other conditions and warranties, express or implied, statutory or otherwise, arising from prior dealings, usage or trade practice, with respect to the Products and Sales Channels.
Nothing in these Terms of Sale limits or excludes our liability for any liability that cannot be limited or excluded by applicable law. Subject to the preceding sentence, our cumulative liability to you under these Terms of Sale for your order, whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damage, shall in no event exceed the full amount (100%) of the price of the Products you have ordered.
20. General Provisions
If any provision or part of any provision of these Terms of Sale is found to be illegal, invalid or unenforceable, that provision or part of the provision shall be deemed not to form part of these Terms of Sale but shall not affect the legality, validity or enforceability of the remaining provisions of these Terms of Sale, unless otherwise required by operation of applicable law.
These Terms of Sale (and any related terms incorporated by reference herein) constitute the entire agreement between you and us relating to the ordering of goods and services and replace and extinguish all contracts, draft contracts, arrangements, undertakings and collateral agreements of whatever nature previously concluded between the parties, oral or written, relating to such subject matter.
We shall not be liable for any failure or delay in the performance or failure to comply with any obligation under these Terms of Sale due to any cause beyond our reasonable control.
Our waiver of any breach of any provision of these Terms of Sale shall not be deemed to be a waiver of any other or subsequent breach.
This contract is between us and you. No other person shall have any right to enforce any of its terms. However, if you purchase an item as a gift, the recipient of that gift will be covered by the warranty.
21. Governing Law and Jurisdiction
These Terms of Sale shall be interpreted in accordance with the laws of Japan.
Without any limitation on bringing legal proceedings in court, you and Unexplored shall first use reasonable efforts to amicably resolve any dispute or situation in which no agreement can be reached arising out of or relating to the Products, these Terms of Sale, or the breach thereof, for a period of 30 days.
